Terms of Service

  1. Acceptance of Terms By accessing or using the Talent Pathway platform (the "Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the Service.
  2. Definitions "External Service": Any software used by Talent Pathway in connection with the provision of the Service that is administered by a third party. External Services include, but are not limited to, DNS servers, hosting providers, email servers, and similar systems.
  3. "Unavailable": The Service is considered unavailable if the Customer is unable to access it.

    "Planned Downtime": Any instance where Talent Pathway intentionally causes the Service to be unavailable, usually for maintenance or upgrades.

  4. Service Commitments and Credits Customers may receive refunds at Talent Pathway’s discretion by submitting a written request no later than 30 days after the last day of the month during which the unavailability occurred. Refunds, if applied, will not exceed the respective monthly customer fee.
  5. Exclusions Refunds will not be awarded in the following situations:
    • The Customer's account is not verified, including instances where the account has not undergone the verification process or has failed verification.
    • Unavailability attributable to an External Service.
    • Unavailability due to Customer’s equipment, software, or network.
    • Planned Downtime, provided that Talent Pathway ensures no more than four instances of Planned Downtime during any thirty-day period.
    • Unavailability caused by actions of the Customer or their personnel or agents.
    • Unavailability attributable to general Internet services (e.g., DNS, internet backbone).
    • Unavailability caused by force majeure circumstances (e.g., fires, floods, acts of God, government actions, civil unrest, ISP failures, denial of service attacks).
  6. Data Export Talent Pathway offers subscribers one free data export per year (in CSV or Excel format).
    • To request and receive a data export, the Customer’s account must be active with all invoices paid.
    • For non-subscribers or requests different from CSV/Excel formats, Talent Pathway may charge for the export depending on data size and type.
  7. Login and Access to the Service If Talent Pathway detects repeated access to the Service from various locations, devices, or IP addresses under the same login, the Company reserves the right to immediately suspend access for the relevant Customer and connected accounts. Simultaneous access from different devices and IP addresses under the same login is not allowed.
  8. Modifications to Terms Talent Pathway reserves the right to update these Terms at any time. Changes will be communicated through the platform or via email. Continued use of the Service after changes are made constitutes acceptance of the new Terms.
